When You Cover Legal Costs

You agree to indemnify Strike Stock AI only for claims arising from:

• Your breach of these Terms
• Your violation of applicable law while using our services
• Your infringement of third-party rights
• Your unauthorized sharing of account access or proprietary information

This indemnification does NOT apply to:

• Claims arising from our negligence
• Errors in our data or systems
• Our breach of these Terms

Fair is fair—you're responsible for your actions, we're responsible for ours.

Maximum Liability = What You Paid Us

IN NO EVENT SHALL STRIKE STOCK AI BE LIABLE FOR DAMAGES EXCEEDING THE SUBSCRIPTION FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

Translation: If you paid us $50/month for 6 months, our maximum liability is $300.

Specifically, we're not liable for:

• Investment losses (you make your own trading decisions)
• Lost profits or opportunities
• Indirect, incidental, or consequential damages

THIS LIMITATION DOES NOT APPLY TO:

• Damages caused by our gross negligence or willful misconduct
• Violations of federal or state securities laws
• Unauthorized disclosure of your personal information
• Death or personal injury caused by our negligence
• Any other liability that cannot be limited under applicable law

 "As Is" Means "As Is"

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, express or implied, including but not limited to:

• Accuracy or completeness of data
• Reliability of pattern recognition
• Profitability of identified patterns
• Fitness for any particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation

We're constantly improving our technology, but we can't guarantee perfection. Use our tools wisely and combine them with other research—they're meant to empower, not replace your judgment.

How We Handle Disagreements

Arbitration Agreement:
Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration administered by JAMS in accordance with its Comprehensive Arbitration Rules and Procedures. Arbitration shall be governed by the Federal Arbitration Act to the fullest extent permitted by law.

Arbitration Details:

• Location: Arbitration shall be conducted in Oakland County, Michigan (or remotely, if both parties agree)
• Costs: Each party shall bear their own attorneys' fees; arbitration fees shall be allocated per JAMS rules
• Small Claims Court: Either party may bring an individual action in small claims court
• Injunctive Relief: We may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property

Opt-Out Right:
You may opt out of this arbitration agreement within 30 days of first accessing the service by sending written notice to: Strike Stock AI, Inc., 16192 Coastal Hwy, Lewes, DE 19958, Attn: Legal Department.

Class Action Waiver:
You agree to bring claims only in your individual capacity and not as part of any class or representative action. This waiver may not be enforceable in all jurisdictions.

Governing Law:
These terms are governed by Delaware law, except that Michigan law governs to the extent required for Michigan residents.

We hope it never comes to that, but if there's ever a disagreement, this is simply how we'll handle it—fairly and efficiently.

Playing By The Rules

Market Manipulation:
You agree not to use our services for market manipulation, insider trading, or any other unlawful purposes. Don't be that person.

International Users:
Our services are designed for U.S. markets and U.S. persons only. We do not offer services to persons in jurisdictions where such offerings would be unlawful. If you access our services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

Regulatory Changes:
We reserve the right to modify our services to comply with changing regulations. Financial regulation evolves—we'll adapt as needed.

What Your Subscription Includes (And Doesn't)

Access:

• Subscription provides access to tools and data only
• We may modify or discontinue features with notice
• Terminated accounts lose all access immediately
• No refunds for unused subscription periods (but you can cancel anytime)

Prohibited Uses:

• Commercial redistribution
• Automated scraping or downloading
• Sharing login credentials
• Circumventing access controls
• Using our services to harm others or markets

Cancellation:
You can cancel your subscription anytime. Month-to-month, no long-term commitment. If you're not finding value, don't pay for it.

What Our Team Can (And Can't) Help With

• Troubleshoot technical issues
• Explain how our tools work

Our support team CANNOT and WILL NOT:

• Provide investment advice
• Interpret patterns for specific trades
• Recommend securities
• Discuss whether you should buy, sell, or hold

If you ask "Should I buy this stock?", our answer will always be: "We can't answer that—talk to a financial adviser."

Keep Your Stuff Secure

Account Security:
You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized access. We are not liable for losses resulting from unauthorized use of your account, except as required by applicable law.

We use commercially reasonable measures to protect your information, but no online system is 100% secure. We're continually improving our security practices to protect you and your data.

Pro tip: Use a strong, unique password. Enable two-factor authentication if we offer it. Don't share your login.
